The Retained EU Law (Revocation and Reform) Bill raises serious concerns for legal certainty and – more fundamentally still – for the role of Parliament in law-making. An excellent and impartial introduction to the Bill is in this report from the House of Commons library.
My initial thoughts on the delegated powers in the Bill are recorded in these notes for a presentation yesterday evening to the Bar European Group, which was also addressed by Sir Jonathan Jones KC (Remarks to BEG on Retained EU Law Bill 19-10-22) and Schona Jolly KC. Bottom line: Parliament should push back, and not vote to marginalise itself.
